JUMPYBUMPY has spent considerable time and resources seeking clarification of Instructors’ rights and responsibilities relating to the public performance of recorded music - we’ve always believed an Instructor should be able to purchase his/her recordings from any source without having to pay for more than one public performance licence. We set out below our understanding of the current legal position.

A licence from the copyright owner is needed if you play sound recordings in public - whether through a background music system, on CD, via radio/television broadcasts or otherwise. In the UK the right to publicly perform most (but not all) sound recordings is administered by Phonographic Performance Limited (“PPL”).

Contrary to popular belief:-

• Instructors are not legally obliged to purchase multiple licences from PPL simply because they play recorded music obtained from more than one source during their classes. One licence from PPL permits an Instructor to use all sound recordings administered by PPL (although different licence fees are payable to PPL depending on whether or not the Instructor conducts more than 200 classes each year).
  
  
• JUMPYBUMPY distributes MOVE YA! CDs for which all the necessary manufacturing licences have been obtained from the relevant rights holders.
  
  
• JUMPYBUMPY is not legally required to sell public performance licences to accompany the sound recordings it distributes – any more than HMV or any other high street retailer of sound recordings. JUMPYBUMPY encourages and expects its customers to ensure that they hold appropriate public performance licences to cover the full extent of their activities (and JUMPYBUMPY’s terms and conditions of supply expressly require that Instructors hold or obtain such licences) but ultimately it is the job of PPL - not distributors like JUMPYBUMPY - to ensure Instructors hold the necessary public performance licence.

It is our understanding that music suppliers such as Pure Energy and Solid Sound have an agreement with PPL which requires them to sell PPL licences as part of their music subscription service. This means that in order to access their catalogue of music, an Instructor must purchase a PPL licence from them, whether or not they already hold one. JUMPYBUMPY has no such agreement with PPL and therefore any Instructor holding a valid PPL licence can purchase any MOVE YA! CD from JUMPYBUMPY without having to purchase any further licences from PPL.
